Explaindio 5 AI: Terms of Use and Refund Policy

1. Who we are

These terms are between you and Explaindio LLC, a Delaware limited liability company with its main office at 41 Watchung Plz, Ste #252, Montclair, NJ 07042 ("we", "us"), for Explaindio 5 AI and its upgrades.

By buying or using Explaindio 5 AI, you agree to these terms.

2. What you're buying

  • Explaindio 5 AI (one-time payment): the business finder, website checks, the contact finder, sample videos, sample pages, the email writer and outreach log, the full-video unlock, the Explaindio studio, and a commercial license.
  • Upgrades: the Explaindio 5 Niche Campaign Pack, Explaindio 5 Pro or Pro Lite (one-time or monthly), the Explaindio 5 Fix-It Pack, Explaindio 5 Agency or Explaindio 5 Agency Lite, and Explaindio 5 Done-For-You Leads (monthly).
  • The Explaindio 5 AI Bundle (yearly): everything above, with Explaindio 5 Done-For-You Leads for as long as the Bundle is active.

Each product includes what its sales page says at the time you buy it. We may improve and change Explaindio 5 AI over time.

3. Allowances, credits and fair use

Your plan includes searches and sample videos, as listed on its sales page. Explaindio 5 AI is a one-time purchase: it includes business searches, with up to 50 businesses in each, and 800 credits for sample videos and other work. Plans with monthly allowances (for example, Explaindio 5 Pro) list them on their sales pages.

Monthly allowances reset on the 1st of each month, at midnight UTC. Unused searches and sample videos don't carry over.

Website checks aren't counted toward your allowance. They are still subject to fair use: we may slow or pause automated checking that looks like abuse, or that harms our service or other users.

Explaindio 5 Agency client workspaces share the account owner's monthly allowance and use the account owner's credits. In a client workspace, the AI planning of each video uses 10 credits on top of the video itself, each email the AI writes uses 1 credit, and each stock photo the AI checks uses 1 credit (at most 6 for one picture).

4. Your outreach: you are the sender

Explaindio 5 AI helps you find businesses, make sample videos, and write emails. You decide who to contact, you read each email, and you send it yourself, from your own email or your own connected tool.

That means:

  • You are responsible for following the laws that apply to your emails and calls, where you are and where the business is. In the US, that includes the CAN-SPAM Act. Outside the US, stricter rules can apply to business email, such as Canada's CASL, the UK's and the EU's PECR and GDPR, and Australia's Spam Act.
  • Every email includes a footer with your name, your business, your postal address, and an opt-out link. You must provide true details. The footer can't be removed.
  • Opt-outs are honored automatically. When a business opts out, it can no longer be contacted from your account. You must not contact it by other means to get around this.
  • You use your own sending tools and accounts (for example your own CRM, email tool or map key) under their own terms. Charges from those services, like your map provider's, are between you and them.
  • Don't use Explaindio 5 AI to send spam, harass anyone, mislead a business about who you are, pretend to be the business, or contact anyone who asked not to be contacted.

5. Getting paid by your clients: you are the seller

Explaindio 5 AI lets you take payment from your own clients on their sample pages, through your own payment link.

When you do:

  • You are the seller. The sale is between you and your client. Explaindio LLC is not a party to it.
  • The money goes to you. Your client pays through your own payment link, with the payment service you chose. Explaindio never holds, receives or controls your clients' money.
  • Refunds, disputes and chargebacks are yours to handle with your client, under your own policies and your payment service's rules. A video that was delivered stays delivered.
  • Your price, your promises. You set the price and describe the work. You are responsible for delivering what you promised your client.
  • Taxes and your payment service's terms are yours. You handle any taxes on your sales, and you follow the terms of the payment service you use.
  • Explaindio's part is the software: it shows your payment link to your client, lets your client tell you they have paid, and, when you confirm the payment yourself, puts the full video on your client's page. Explaindio does not check or confirm payments. If a delivery has a problem, contact support, and we'll help you sort it out.

6. Sample videos and the businesses in them

Sample videos are made from information a business publishes on its own website.

The sample page is clearly marked as a sample made by you, not published by the business. It has a watermark, and it can't be downloaded.

  • Use a sample only to show that business what a video for it could look like.
  • Don't publish a business's sample video anywhere else, or present it as the business's own, unless the business has agreed (for example, after it pays you).
  • If a business asks you to take its sample page down, make a new link or delete it.

A sample page is a private demonstration for that business. Before a video is used publicly, you are responsible for having the business's permission.

We may take a sample page down, or remove a business from Explaindio, if the business asks us to.

7. Licenses

Commercial license (Explaindio 5 AI): you may make videos for clients and charge them for the work.

Explaindio 5 Agency license (Explaindio 5 Agency, Explaindio 5 Agency Lite): Give each client their own Explaindio login inside your account, and show your own brand, not ours, on the sample pages you send for them, for as long as your Agency plan is active. You can charge your clients for this work. You can’t resell or give away Explaindio itself.

Your client's rights: once your client pays you, what they may do with their finished video is between you and your client. (The Explaindio 5 Fix-It Pack's service agreement template is a starting point, not legal advice.)

Stock photos and videos: the free stock photos and videos in the editor, and the ones Explaindio adds to videos it makes for you, come from Pexels and Pixabay, under their own licenses: the Pexels License and the Pixabay Content License. In short, for you and your clients:

  • You may use them in the videos you make, including videos you sell to clients, with no fee and no credit needed.
  • You may not sell or give away a stock photo or clip on its own, without changing it (for example, as a download or a print).
  • You may not show a recognizable person in a way that suggests they recommend or endorse a business, product or service.
  • Logos, trademarks, brands or artwork that appear in a photo aren't licensed to you. Check before you use a photo that shows them.

8. Payments, renewals and cancellation

Payments are processed by WarriorPlus.

  • One-time purchases (Explaindio 5 AI, the Explaindio 5 Niche Campaign Pack, Explaindio 5 Pro or Pro Lite one-time, the Explaindio 5 Fix-It Pack, Explaindio 5 Agency Lite): paid once.
  • Explaindio 5 Pro monthly: renews each month until you cancel. If you stop, your account goes back to the Explaindio 5 AI level. You keep the app and every video you've made.
  • Explaindio 5 Done-For-You Leads monthly: renews each month until you cancel. You can cancel any time. The businesses already in your list stay there.
  • Explaindio 5 Agency: $297 when you buy, billed yearly, and renews each year unless you cancel. If you choose not to renew, your own brand comes off your sample pages right away, and your clients' logins pause until you renew. Nothing is deleted: your clients' work is kept, and their logins work again when you renew. You keep the app, every video you've made, and the Brand Kits you've made.
  • The Explaindio 5 AI Bundle: billed yearly, and renews each year unless you cancel. If you choose not to renew, your account goes back to the Explaindio 5 AI level. You keep the app and every video you've made. You lose the upgrades, Explaindio 5 Agency and Explaindio 5 Done-For-You Leads.

9. Refunds and cancellation

Every Explaindio 5 AI product comes with a 30-day money-back guarantee on its first purchase, counted from the date and time of that purchase. Renewal charges, credit packs and other credits are not refundable. To ask for a refund, contact our support team with the email address you used to buy and your WarriorPlus transaction ID. The refund goes back through WarriorPlus, and access to the refunded product ends. The full Refund and Cancellation Policy is part of these terms.

10. No guarantee of results

Explaindio 5 AI is software. We show you how it works.

We don't promise that any business will reply, buy, or pay you, or that you'll earn any amount of money.

What services cost (as shown in the price sheet) is market information from published sources, not a prediction of your income.

11. Your account and your data

  • Keep your login private. Client workspaces have their own logins. Don't share yours.
  • The business information in your list comes from public sources and the businesses' own websites. Use it only for the outreach described in section 4.
  • Our Privacy Policy explains how we handle your data and the business data in your list.

12. Suspension

We may suspend or close an account that breaks sections 4 or 5, for example by sending spam or ignoring opt-outs, or that harms the service or other users.

13. The legal basics

No warranty. Explaindio 5 AI is provided "as is" and "as available". We work to keep it running and accurate, but we don't promise it will be free of errors or interruptions, or that its website checks and business data are always correct.

Limit of liability. To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost business or lost data. Our total liability for any claim about Explaindio 5 AI is limited to what you paid us in the 12 months before the claim.

Your responsibility. You agree to cover us for claims, losses and costs that come from your outreach, your content, or your breach of these terms.

Governing law and disputes. These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or Explaindio 5 AI will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be seated in the State of New Jersey. Either of us may still seek injunctive or equitable relief in any court of competent jurisdiction.

Class action waiver. You and we agree that each of us may bring a dispute against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not join or consolidate the claims of more than one person, and may not preside over any form of class, collective or representative proceeding. The arbitrator may award relief only to the individual party seeking relief, and only to the extent needed to resolve that party's individual claim. If a court finds this class action waiver unenforceable for a particular dispute, that dispute, and only that dispute, will be decided in court rather than in arbitration, and the rest of these terms stay in force.

Changes to these terms. We may update these terms. We'll post the new version here, with its date. If you keep using Explaindio 5 AI after that, the new terms apply.
